Adequate investigation of complaints of alleged employee misconduct is crucial in these litigious times. Proper investigations not only help you comply with your obligations under the law; they also maintain and preserve employee morale, and often bring to light problems of which you may not have been aware. While your non-legal staff can often conduct these investigations, there are times when an investigation by an attorney is appropriate or necessary to protect your organization. Politically sensitive cases, complex cases, and those involving difficult legal issues may all warrant an attorney-investigator. Investigation Experience
DEM Legal and Consulting conducts investigations of harassment, discrimination and other employment claims, and has developed special expertise as a neutral fact finder. We customarily begin the investigation process by interviewing the employee who brought the issue to your attention. We listen carefully to the individual�s concerns and describe the investigation process. We often take written statements from the complainant, the respondent (the �accused�) and other witnesses. After all the appropriate individuals have given us their perspective, we reach factual findings regarding each issue raised. Once the investigation has been completed, we will prepare a confidential report for the client. We can also assist the client in bringing closure to the process and taking appropriate action, when that is warranted.
