EEOC Investigations And Representation

Advocating For Your Business In EEOC Investigations

At the Law Offices of Denise Eaton May, we pride ourselves on timely, thorough and efficient investigative work. We strive to make our investigations into allegations of employee misconduct as fair, objective and thorough as possible, and to complete them in a timely and efficient manner. Our goal is to comply with any relevant personnel policies or other guidelines that deal with the subject matter of the complaint.

Adequate investigation of complaints of alleged employee misconduct is crucial in these litigious times. Proper investigations not only help you comply with your obligations under the law; they also maintain and preserve employee morale, and often bring to light problems of which you may not have been aware.

While your non-legal staff can often conduct these investigations, there are times when an investigation by an attorney is appropriate or necessary to protect your organization. Politically sensitive cases, complex cases, and those involving difficult legal issues may all warrant an attorney-investigator. When such a need arises, the Law Offices of Denise Eaton May are available to meet your needs.

Investigation Experience

The Law Offices of Denise Eaton May conducts investigations of harassment, discrimination and other employment claims, and has developed special expertise as a neutral fact finder. We customarily begin the investigation process by interviewing the employee who brought the issue to your attention. We listen carefully to the individual’s concerns and describe the investigation process.

We often take written statements from the complainant, the respondent (the “accused”) and other witnesses. After all the appropriate individuals have given us their perspective, we reach factual findings regarding each issue raised. Once the investigation has been completed, we will prepare a confidential report for the client. We can also assist the client in bringing closure to the process and taking appropriate action, when that is warranted.

Helping You Maintain An Environment Of Success

As an employer, you strive to create and maintain an environment in which your business can succeed and your workers can thrive. Any situation that leads to a dispute with an employee can not only quickly disrupt the employment relationship, but also subject you to significant legal and financial liability.

The investigation process established by the Equal Employment Opportunity Commission (EEOC) was designed to ensure a fair and comprehensive vetting of the most common employee complaints. While the process is in theory fair to all parties, this absolutely does not mean that your business can afford to do without the guidance and advice of an experienced employment law attorney to protect your most vital interests.

With more than three decades of successful employer representation in California, Denise Eaton May and our legal team are prepared to help you achieve a successful and timely resolution to any employment dispute in which your business finds itself.

Our Job Is To Help You Protect Your Business

If the EEOC has notified you of a charge levied against your business as a result of allegations of discrimination, harassment, retaliation or any other employment-related claim, you will be required to submit to a multi-part process in which the Commission gathers information from both sides in order to reach a decision about the claim.

Our role as lawyers and counsel is to ensure your fair treatment through every step of this process. This includes ensuring that the Commission does not overstep its authority in carrying out any of its duties. We can guide you through all the steps of the process, including:

  • Submitting your Statement of Position
  • Appropriately responding to a Request for Information
  • Ensuring proper handling of an on-site visit
  • Arranging witness interviews with other employees

Our firm is also experienced in direct settlement negotiations and in mediation. As part of our counsel, we will determine whether either of these voluntary dispute resolution alternatives is in the best interests of your business.
